They say that when you fail to prepare, you prepare to fail and in the world of virtual mediation and online dispute resolution this is especially true! The true path to a successful resolution starts long before the first mediation session actually begins and the attorney bears much of the responsibility for making sure the client is ready to go when they click the link to join the meeting. The client needs to know what practical information they need in advance, such as the programs being used and the equipment and set up that they will need to participate. Then there are all the process factors and issues of privacy and confidentiality to be communicated and understood. Finally, advocates should be aware of the potential for unconscious bias against an unprepared client.

Preparing your client for mediation is the same and much of an attorney's effort should properly be focused on the process before the mediation begins.
